Wayne L. Allen JD, LLM

Wayne L. Allen conducts his work exclusively in the area of Employment Law, in Melbourne, Florida. His practice has spanned 38 years, including sixteen years as an in-house corporate counsel and 14 years in private practice.

He is a graduate of the University of Miami with a Bachelor of Arts degree, 1962, Juris Doctorate, 1968, and Master of Laws, 1977. He is a member of The Florida Bar and is admitted to practice before the U.S. District Court, Middle District of Florida, U.S. District Court, Southern District of Florida, the U.S. Court of Appeals, 11th Circuit, and the U.S. Supreme Court. In addition, he is a Certified Circuit Court Mediator.

He served on active duty in the U.S. Navy and retired after 22 years in the U.S. Naval Reserve with the rank of Captain. During his corporate counsel years, he served as Chairman of the Corporate Counsel Committee for The Florida Bar.

Mr. Allen's areas of expertise include unemployment compensation claims, sexual harassment, sex discrimination, age discrimination, employment contracts. He successfully obtained a Rule 50 Judgment in the U.S. District Court, Middle District of Florida, when the court ruled as a matter of law, at the end of the defendant's case, for the plaintiff, in a Family and Medical Leave Act action. That resulted in a final judgment for the plaintiff of $100,000 plus the award of attorney fees. That judgment was affirmed on appeal by the Federal 11th Circuit. He also has successfully litigated age discrimination and sexual harassment cases, winning them both at trial and on appeal. See for instance: Dupont v. Speedway, a sexual harassment case, recently affirmed by the Fifth District Court of Appeals, in an 8-1 decision, resulted in $80,000 in mental anguish and punitive damages for the plaintiff, where actual damages were minimal.
